By participating in Activities organized by Fasset, you agree to comply with these Terms and Conditions, including any changes that may be made, as well as Fasset's decisions which are final and binding in all matters.

1. Definition

1.1 Activity: Refers to Bull Run Combo Week.

1.2 Activity Organiser: Refers to the individual, entity or organisation responsible for planning, managing and implementing the Activity. This includes the primary organising entity, subsidiaries, affiliates, employees, contractors, agents or representatives acting on behalf of the organising entity or entities, and/or partners or sponsors who are given specific responsibilities in the process of organising the Activity. This also includes, but is not limited to, entities carrying out the following roles and responsibilities:

• 1.2.1 Establish rules and guidelines for Activities.
• 1.2.2 Promote and market the Activity to potential Participants.
• 1.2.3 Managing Participant registration.
• 1.2.4 Organizing events, workshops and other activities related to the Activity.
• 1.2.5 Announcing winners and distributing prizes.

1.3 Affiliates: Refers to any entity that directly or indirectly controls, is controlled by, or is under common control with Fasset. For the purposes of this definition, “control” means ownership or voting rights of more than fifty percent (50%) of the shares or voting interests of an entity or the ability to direct the management or policies of an entity, whether by ownership, contract, or otherwise. The term “Affiliates” includes, but is not limited to, parent companies, subsidiaries, sister or related companies (entities controlled by the same parent company), and other business entities in which Fasset holds a significant ownership interest or exercises significant influence over the management and operations. It also includes all employees, contractors, agents or representatives acting on behalf of Fasset or any related company or entity as described above. Unless expressly stated otherwise, any reference to Fasset in these Terms includes its Affiliates. Fasset may fulfill its responsibilities and obligations under these Terms through its Affiliates. When acting on its behalf, Affiliates shall be subject to the same Terms as Fasset.

1.4 Applicable Law: Refers to all applicable laws (federal, state and local) and applicable rules, orders, guidelines and regulations of any Governmental Authority which, in each case, apply or may become applicable to Fasset and the performance of its obligations or exercise of its rights under this Agreement or which apply to Participants and the performance of their obligations or exercise of their rights under this Agreement, or, as the context requires, apply to any other party affected by the subject matter of this Agreement. Applicable Law also includes but is not limited to the relevant data protection laws of the Republic of Indonesia.

1.5 BTC: Refers to the crypto asset Bitcoin.

1.6 Coins: Refers to the crypto assets available on the Fasset app.

1.7 DOT: Refers to the crypto asset DOT.

1.8 ETH: Refers to the Ethereum crypto asset.

1.9 Employees: Refers to any and all individuals employed by Fasset or its affiliates, whether on a full-time, part-time, temporary, or permanent basis, and who receive compensation in the form of wages, salaries, or other remuneration in exchange for their services. This definition includes, but is not limited to, executive officers, managers, administrative staff, technical staff, workers, and other individuals who provide services to the Company under its direction and control. The term “Employees” does not include independent contractors, consultants, or any other person not directly employed by Fasset or its affiliates.

1.10 Fasset: Refers to PT Gerbang Aset Digital.

1.11 Governmental Authority: Refers to any governmental, regulatory or administrative authority, body, commission, board, bureau, court or agency (including but not limited to any central bank, monetary authority or stock exchange) having jurisdiction over a Party and its services and/or over these Terms.

1.12 IDR: Refers to Indonesian Rupiah.

1.13 Intellectual Property: Refers to all copyrights, patents, trademarks, trade secrets and other proprietary rights protecting inventions, designs, writings or other forms of intellectual creation or derivatives or improvements thereto, which are recognized as benefiting from the laws governing the same in the territory of the Republic of Indonesia or other jurisdictions. This includes other forms, variations or versions of intellectual property that are not yet known. This includes, but is not limited to, the following:

• 1.13.1 All computer programs, including source code, object code, algorithms, databases, and associated documentation;
• 1.13.2 Any set of instructions, including source code and execution, used in software development or other technological processes;
• 1.13.3 Practical knowledge, techniques, skills, methodologies, processes and practices that are not generally known to the public;
• 1.13.4 Data, designs, drawings, specifications, manuals, flowcharts and other technical documentation;
• 1.13.5 Physical or digital components, prototypes, models, samples, or other tangible or intangible materials used in or resulting from the research, development, or creative process;
• 1.13.6 Any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof;
• 113.7 The ornamental or aesthetic aspects of a useful article, web page or electronic user interface or experience;
• 1.13.8 Any word, name, symbol, design, or combination of these, used to identify and distinguish goods or services.
• 1.13.9 Any information that has independent economic value because it is not generally known, and is not readily available to others who could derive economic value from its disclosure or use.

1.14 Intellectual Property Rights: Refers to the legal rights granted to the creator or owner of Intellectual Property. These rights give the creator or owner exclusive control over the use, distribution, and modification of their intellectual works, including but not limited to inventions, designs, writings, and any derivative works or improvements thereto.

1.15 KYC: Refers to the Know-Your-Customer procedures implemented by Fasset to verify the identity of its Users in accordance with Applicable Laws and regulations in the Republic of Indonesia.

1.16 PPh: Refers to Income Tax as regulated in the tax regulations in force in Indonesia.

1.17 VAT: Refers to Value Added Tax as regulated in the tax regulations in force in Indonesia.

1.18 Participant: Refers to any individual who meets the eligibility criteria as set out in Clause 2 of these Terms.

1.19 Platform : Refers to the website, related websites or mobile sites, mobile applications and/or APIs owned, controlled, operated and managed by Fasset, as well as any changes thereto from time to time, and/or mobile applications accessible on iOS and Android through the application called 'Fasset'.

1.20 Privacy Policy: Refers to Fasset's Privacy Policy as stated in Privacy Policy .

1.21 SOL: Refers to the Solana crypto asset.

1.22 TRON: Refers to the crypto asset Tron.

1.23 Terms: Refers to, collectively, the Terms and Conditions of this Activity.

1.24 Time Period: Refers to the time period of the Activity which will take place from November 18, 2024 at 00:00 WIB to November 25, 2024 at 23:59 WIB.

1.25 USDT: Refers to the crypto asset Tether.

1.26 User: Refers to any individual who can access the Platform .

1.27 User Agreement: Refers to the Fasset User Agreement as found in https://fasset.id/user-agreement-indonesia/ .

1.28 Verified Users: Refers to Fasset users in Indonesia who have completed the KYC process at Fasset either through the Fasset application or through MyIM3 for Indosat customers.

1.29 XRP: Refers to Ripple's crypto asset.

2. Eligibility and Registration

2.1 Fasset employees are permitted to participate in this Activity.

2.2 Participation in this Activity is only available to Verified Users based in Indonesia.

2.3 All Participants must have completed the KYC process and become a Verified User.

2.4 All Participants must follow the Instagram social media account @fasset_id to be eligible to participate in this Activity.

2.5 Fasset reserves the right to verify the eligibility of Participants. Ineligible Participants may be disqualified at Fasset's discretion. Participants will be notified of significant changes through official channels.

2.6 Activities are only valid during the Term for the first 3 (three) transactions with the following transaction types:

2.6.1 Deposit and purchase transactions; and

2.6.2 Purchase transactions only;

2.7 Exchange transactions are not valid in this Activity.

3. Gifts

3.1 Prizes will consist of:

•       3.1.1 Cashback 1 USDT for purchase transactions of IDR 250,000.00; and
•       3.1.2  Cashback 2 USDT for purchase transactions of IDR 500,000.00.

3.2. 3.6 USDT prizes will be distributed to the winner's wallet within a maximum of 14 business days after the winner announcement, depending on the winner responding to Fasset's communication and efforts through the specified communication channels. If the winner does not respond within 3 business days after being contacted by Fasset, Fasset reserves the right to replace the winner and revoke the prize that has been awarded without any obligation or responsibility to cancel the decision at a later date. Each winner hereby accepts and understands these provisions through their acceptance of these Terms and Conditions and their participation in this activity.

3.7 Prizes awarded are non-transferable and cannot be exchanged for cash or other alternatives.

3.8 Fasset, at its sole discretion, may substitute any prize won with a prize of equal or greater value.

3.9 Prizes consist only of items explicitly stated on the Instagram social media account @fasset_id and do not include any other costs or expenses that may arise during the receipt and enjoyment of the prize.

3.10 If a prize notification is returned as undeliverable or the winner fails to respond as specified in the notification, including within the specified time, the winner may be disqualified, and an alternate winner may be selected.

3.11 By accepting a prize, Participants consent to the use of their name, place of residence, age and/or prize information for promotional and other reasonable purposes without further payment, unless prohibited by Applicable Law.

3.12 Complaints regarding USDT cashback rewards , if any, can be filed within 14 days of receiving the reward.

3.13 Decisions regarding prize winners made by Fasset are final and irrevocable.

4. Prohibition of Insult

4.1 Participants agree not to make any false, misleading or derogatory statements about Fasset, the Event Organizer or their affiliates, either orally or in writing, including but not limited to statements about the following:

• 4.1.1 Activities, their rules and administration; and
• 4.1.2 The performance, conduct or business practices of Fasset, the Event Organizer or their affiliates.

4.2 The prohibition on insults does not limit the following:

• 4.2.1 Provide accurate information in response to legal proceedings, regulatory inquiries, or government investigations;
• 4.2.2 Make statements required by applicable laws or regulations; or
• 4.2.3 Share feedback or criticism that is constructively intended to improve the Activity or its results directly to Fasset through private communication channels.
• 4.2.4 Under no circumstances will public comments or criticism be accepted, and in such circumstances, Fasset reserves the right to claim compensation for losses suffered by such public insults to the extent permitted by Applicable Law.

4.3 In the event of a violation of the prohibition on defamation, Fasset may seek damages, and other remedies available at law.

4.4 For the purposes of this Clause 4, the Dispute Resolution provisions in Clause 10 do not apply to Fasset, and Fasset may pursue any claim against a breach in any forum in the world.

5. Conditions of Entry and Release

5.1 By participating in this Activity, each Participant agrees to the following:

• 5.1.1 The relationship between the Participant and Fasset is not a confidential, fiduciary, or other special relationship.
• 5.1.2 Setiap Peserta akan terikat oleh dan mematuhi Syarat dan Ketentuan ini;
• 5.1.3 Keputusan Fasset bersifat mengikat dan final dalam semua hal yang berkaitan dengan Aktivitas;
• 5.1.4 Sejauh diizinkan oleh Hukum Yang Berlaku, setiap Peserta setuju untuk membebaskan, mengganti rugi, membela, dan tidak menyalahkan Fasset, Penyelenggara Aktivitas, Afiliasi mereka dan pemasok hadiah, serta organisasi lain yang bertanggung jawab untuk mensponsori, memenuhi, mengelola, mengiklankan, atau mempromosikan Aktivitas, bersama dengan petugas, direktur, karyawan, agen, dan perwakilan mereka saat ini dan sebelumnya (secara kolektif disebut sebagai “Pihak yang Diberikan Ganti Rugi”) dari dan terhadap semua klaim, biaya, dan kewajiban (termasuk biaya pengacara yang wajar), termasuk namun tidak terbatas pada kelalaian dan kerusakan dari jenis apapun terhadap orang dan properti, pencemaran nama baik, fitnah, pelanggaran hak publisitas, pelanggaran merek dagang, hak cipta, atau Hak Kekayaan Intelektual lainnya, kerusakan properti, atau kematian atau cedera pribadi, yang timbul dari atau terkait dengan Aktivitas, entri Peserta, partisipasi dalam Aktivitas, penerimaan atau penggunaan atau penyalahgunaan hadiah dan/atau penyiaran, transmisi, pertunjukan, eksploitasi, sebagaimana diizinkan atau dilisensikan oleh Syarat dan Ketentuan ini;

5.2 Tanpa membatasi hal tersebut, Pihak yang Diberikan Ganti Rugi tidak akan memiliki kewajiban sehubungan dengan:

• 5.2.1 informasi yang salah atau tidak akurat, baik yang disebabkan oleh kesalahan elektronik atau cetak atau oleh peralatan atau pemrograman yang terkait dengan atau digunakan dalam Aktivitas;
• 5.2.2 kegagalan teknis dari jenis apapun, termasuk namun tidak terbatas pada malfungsi, gangguan, atau pemutusan saluran telepon, konektivitas internet, kesalahan transmisi elektronik, atau kegagalan perangkat keras atau perangkat lunak jaringan;
• 5.2.3 intervensi manusia yang tidak sah dalam bagian mana pun dari proses entri atau Aktivitas; kesalahan teknis atau manusia yang mungkin terjadi dalam administrasi Aktivitas; dan/atau
• 5.2.4 cedera atau kerusakan pada orang atau properti yang mungkin disebabkan, secara langsung atau tidak langsung, seluruhnya atau sebagian, dari partisipasi Peserta dalam Aktivitas atau penerimaan atau penggunaan atau penyalahgunaan hadiah apa pun.

6.   Lisensi

Dengan mengikuti Aktivitas ini, setiap Peserta memberikan kepada Fasset selaku Penyelenggara Aktivitas, dan masing-masing Afiliasi mereka lisensi berbayar penuh, non-eksklusif, dapat dialihkan, dapat dilisensikan, berlaku di seluruh dunia, dan abadi untuk menampilkan secara publik dan menggunakan detail pemenang untuk tujuan promosi. Lisensi ini termasuk, namun tidak terbatas pada, memposting, atau menautkan ke detail pemenang, situs web dan aplikasi Penyelenggara Aktivitas dan Afiliasi kami, termasuk situs web mereka, serta menampilkan dan mempromosikan Pemenang di media lain di seluruh dunia sebagaimana ditentukan oleh Fasset atas kebijakannya sendiri.

7. Ketentuan Umum

7.1 Fasset berhak secara sepenuhnya dan mutlak, tanpa pemberitahuan sebelumnya kepada Peserta, untuk:

• 7.1.1 mengubah atau membatalkan acara kapan saja karena keadaan yang tidak terduga;
• 7.1.2 mengubah atau mengamandemen Syarat dan Ketentuan ini; dan/atau
• 7.1.3 mendiskualifikasi Peserta dengan alasan apapun.

7.2 Kegiatan ini masih tunduk pada Perjanjian Pengguna, Kebijakan Privasi, dan syarat dan ketentuan tambahan Fasset yang tercantum di situs web kami.

7.3 Peserta bertanggung jawab untuk memberikan informasi yang akurat dan lengkap. Fasset tidak bertanggung jawab atas kesalahan atau kelalaian dalam informasi yang diberikan oleh Peserta. Peserta setuju untuk melepaskan semua tanggung jawab terhadap Fasset atau Afiliasinya atas klaim yang timbul akibat pemberian informasi yang tidak akurat atau tidak lengkap oleh mereka dan tindakan yang diambil oleh Fasset sehubungan dengan partisipasi Peserta dalam Kegiatan atau alokasi hadiah.

7.4 Fasset tidak bertanggung jawab atas masalah teknis yang mungkin mempengaruhi partisipasi, termasuk namun tidak terbatas pada masalah konektivitas internet atau Formulir. Peserta setuju untuk melepaskan semua tanggung jawab terhadap Fasset atau Afiliasinya atas klaim yang timbul akibat keadaan tersebut dan tindakan yang diambil oleh Fasset sehubungan dengan partisipasi Peserta dalam Kegiatan atau alokasi hadiah.

7.5 Peserta harus mematuhi semua hukum dan peraturan yang berlaku selama Kegiatan dan selama menerima hadiah. Fasset tidak bertanggung jawab atas konsekuensi hukum yang timbul dari partisipasi dalam acara tersebut. Kegagalan mematuhi persyaratan hukum dapat menyebabkan diskualifikasi dan kehilangan hadiah yang ditentukan oleh Fasset atas kebijakannya sendiri.

7.6 Setiap upaya oleh siapa pun untuk merusak pelaksanaan Kegiatan yang baik dapat merupakan pelanggaran hukum pidana dan perdata. Jika Fasset mencurigai bahwa upaya tersebut telah dilakukan atau diancamkan, Fasset berhak mengambil tindakan yang sesuai termasuk namun tidak terbatas pada meminta Peserta untuk bekerja sama dalam penyelidikan dan merujuk ke otoritas penegak hukum pidana dan perdata jika diperlukan.

7.7 Promosi hadiah tidak merupakan dukungan atau jaminan oleh Fasset terhadap hadiah atau produk atau layanan terkait.

7.8 Jika sewaktu-waktu selama Kegiatan, seorang Peserta atau calon Peserta merasa bahwa Syarat dan Ketentuan ini tidak jelas atau ambigu, mereka harus mengajukan permintaan tertulis melalui email untuk klarifikasi ke [e-mail].

7.9 All Intellectual Property and Intellectual Property Rights related to the Activities, including but not limited to copyrighted materials, trademarks, trade names, logos, designs, promotional materials, web pages, source code, images, illustrations, slogans and representations, are owned or used under license by Fasset and its Affiliates. All rights are reserved. Unauthorized copying or use of copyrighted materials or Intellectual Property is prohibited. Intellectual Property Rights without the written permission of the owner is expressly prohibited and will be subject to sanctions to the fullest extent permitted by Applicable Law.

8. Data Collection

By participating in this Activity, Participants consent to the collection, use and disclosure of their personal information by Fasset for the purposes of administering the Activity and awarding prizes, and as may be required by law. Personal information will be treated in accordance with applicable data protection laws and Fasset's privacy policy set out here: Privacy Policy .

9. Limitation of Liability

9.1 By participating in this Activity, all Participants agree to be bound by these Terms and Conditions and hereby release Fasset, the Activity Organizer and its Affiliates from any form of liability in connection with the prize or the Participant's participation in this Activity, including but not limited to:

• 9.1.1 any failure to receive a registration entry due to transmission failure or other conditions beyond their control;
• 9.1.2 any late, lost, misdirected, damaged or distorted entries;
• 9.1.3 any disruption, injury, loss or damage caused by events beyond their control;
• 9.1.4 any delay, postponement or change that may affect the prize caused by events beyond their control; and/or
• 9.1.5 any printing or typographical errors in any materials related to this Activity.

9.2 To the extent permitted by Applicable Law, in no event shall Fasset or its Affiliates be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, including but not limited to damages for loss of profits, revenues, goodwill, use, data or other intangible losses, arising out of or in connection with this Activity, regardless of whether such damages were foreseeable or whether Fasset has been advised of the possibility of such damages.

9.3 In no event shall the total aggregate liability of Fasset (or its Affiliates) for all claims arising out of or in connection with this Activity exceed the amount of the entry fee paid by the Participant, or, if no entry fee was paid, one hundred dollars (USD 100) or the then prevailing Rupiah value as determined by Fasset.

9.4 The Participant and Fasset acknowledge that the limitations of liability set out in this clause are an essential basis of the agreement and that the Activity would not be provided without such limitations. By agreeing to these Terms and Conditions, the Participant expressly and explicitly agrees to be bound by the provisions of this Clause 9 and the limitations imposed therein.

10. Dispute Resolution

10.1 Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference into this clause.

10.2 The place of arbitration shall be in Dubai.

10.3 The Arbitration Panel shall consist of 1 (one) arbitrator.

10.4 The language of arbitration shall be English.

10.5 If there is any issue or dispute that is beyond the scope of this arbitration clause for any reason, it will be referred to and finally resolved by the court of the Republic of Indonesia.

11. Applicable Law

These provisions are governed by the laws of the Republic of Indonesia.
